2. THESE TERMS
Applicability of these terms and conditions: These terms and conditions apply to the sale of goods via our website. If you buy goods on our site, you agree to be legally bound by these terms.
In the event that you wish to purchase guns from us, please contact us as such purchases (and any ancillary services related thereto) are subject to separate terms and conditions which we can provide to you on request.
Overseas orders:
In the event that you are purchasing goods via our website from outside of the United Kingdom, these terms and conditions are applicable to you in all respects however there are additional terms that apply to you as set out in clause 13 (Additional Terms relating to Overseas Orders).
3. YOUR LEGAL RIGHTS
A summary of your legal rights are summarised below:
The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that up to 14 days after receiving your
goods, in most cases, you
can change your mind and get a full refund. You will have to pay the costs of return of any goods.
The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. We must provide you with goods that comply with your legal rights. During the expected lifespan of your product your legal rights entitle you to the following:
- Up to 30 days: if your goods are faulty, then you can get an immediate refund.
- Up to six months: if your goods can’t be repaired or replaced, then you’re entitled to a full refund, in most cases.
- Up to six years: if your goods do not last a reasonable length of time you may be entitled to some money back.

3. YOUR PERSONAL INFORMATION

4. PLACING ORDERS WITH US
Once your order has been placed with us (i.e. when you click on the “pay now” button at the end of the online checkout process) we will acknowledge it by email and PayPal will assign a transaction ID to your order and tell you what it is (it will help us if you can tell us the transaction ID whenever you contact us about your order). Please note that this acknowledgement email does not mean that your order has been accepted.
We will only accept your order when we email you to confirm this. At this point:
(a) a legally binding contract will be in place between you and us governed by these terms; and
(b) we will arrange to dispatch the goods to you.
Title to the purchased goods shall not pass until we received payment from you in full and cleared funds.
Circumstances where we may be unable to accept an order:
If we are unable to accept your order, we will inform you of this and will not charge you for the goods. This might be because:
(a) the product is out of stock or unavailable;
(b) of unexpected limits on our resources which we could not reasonably plan for;
(c) we cannot authorise your payment; or
(d) because we have identified an error in the price or description of the product or we are unable to meet a delivery deadline or place of delivery you have specified.
6. PAYMENT METHODS
All payments are managed via PayPal. We accept all major credit cards and debit cards and also accept payment by PayPal. We do not accept cash. We will do all that we reasonably can to ensure that all of the information you give us when paying for the goods is secure by using an encrypted secure payment mechanism.
7. PROMOTIONAL CODES
We may from time to time have promotional offers running on our website. Any promotional codes are subject to the following terms and conditions:
(a) all promotional codes are applied to the value of the order, excluding delivery costs;
(b) a promotional code may be withdrawn at any time;
(c) the promotional code must be entered in to the Voucher Code field on the basket page and applied for the discount to be deducted from the order;
(d) only one promotional code can be applied to each order;
(e) The following items are excluded from the application of promotional codes:
(i) items already reduced in price; and
(ii) items that are clearly marked on our website as being excluded from the benefit of the promotion.
(f) if your basket include items that are both included and excluded from the application of a promotional code, the discount will be applied against the value of included items only.8. GIFT CARDSAll of our gift cards are subject to the following terms and conditions:
(a) our gift cards can only be redeemed for goods that may be purchased online at
https://www.longthorneguns.com as part or full payment for goods. Gift cards cannot be used in connection with the purchase of any of our guns (or ancillary services related thereto);
(b) all gift cards may be applied to the value of the order, excluding delivery costs;
(c) the gift card number must be entered in to the Voucher Code field on the basket page and applied for the credit to be deducted from the order;
(d) any lost, stolen or damaged gift cards will not be replaced;
(e) all gift cards will expire 12 months from the date of its purchase. Any remaining balance upon its expiry will not be refunded;
(f) gift cards cannot be exchanged for cash (whether in full or in part);
(g) there is no limit on the number of gift cards that may be used in one transaction. To transfer the balances from mulitple gift cards onto a single gift card, please contact us;
(h) we will notify you of the remaining balance on your gift card upon completion of each transaction; and
(i) you can enquire about the balance on your gift card by contacting us.9. PRODUCT PRICESThe price of the goods is as displayed on our website and is in pounds sterling (£)(GBP) and includes VAT at the applicable rate.

There may also be additional postage surcharges which have to be levied on our standard postage charges (this is usually due to the size of the items involved or the high cost of the item). We will let you know of any additional postage surcharges with respect to individual items in the product description and/or otherwise in writing.
What if we get the price wrong?
It is always possible that, despite our best efforts, some of the goods we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product's correct price at your order date is less than our stated price at your order date, we will charge the lower amount.
If the product's correct price at your order date is higher than the price stated in our price list, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and Unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract and refund you any sums you have paid.
10. PRODUCT DESCRIPTIONS
The packaging of a product may vary from that shown on images on our website or in our catalogue or brochure. While we try to make sure that:·
all weights, sizes and measurements set out on the site are as accurate as possible, there may be a small tolerance of up to 10% in such weights, sizes and measurements in the following goods: Items of clothing (including caps, capes and skeet vests) and stock oil ]; and the colours of our goods are displayed accurately on the site, the actual colours that you see on your computer may vary depending on the monitor that you use.
11. LEGAL AND TECHNICAL ADJUSTMENTS
Once we have accepted your order we may change the goods for the following reasons:
(a) to reflect changes in relevant laws and regulatory requirements; and
(b) to implement minor technical adjustments and improvements.We will let you know if these changes will affect your use of the goods and you will be given the opportunity to cancel your order as a result.12. CANCELLING OR AMENDING YOUR ORDER
You do not have the right to cancel or amend your order for goods that are made to your specifications or which are personalised/bespoke.
Changes to your order: If you wish to make a change to your order after we have emailed you to confirm that we have accepted it, please contact us as soon as possible and, in any event, before the anticipated dispatch date.
We will let you know if a change to the order is possible. If it is possible we will let you know about any changes to the price of the goods, the timing of delivery or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.
If we cannot make the change or the consequences of making the change are unacceptable to you, you may want to cancel your order.
Order cancellation: You can cancel your order for goods that are not made to your specifications or which are personalised/bespoke at any time for any reason before it has been dispatched to you. Should you cancel your order with us before it has been dispatched, the contract between us will end immediately and we will refund you in full.
You can also end your contract with us before we dispatch the goods to you for the following reasons:
(a) we have told you about an error in the price or description of the product you have ordered and you do not wish to proceed;
(b) we have told you about a change to the product you have ordered and you do not wish to proceed;
(c) there is a risk that supply of the goods may be significantly delayed because of events outside our control;
(d) we cannot deliver within 14 days of your order.
If you are ending the contract for a reason set out at (a) to (d) above the contract will end immediately and we will refund you in full.
How to amend or cancel your order:
To amend or cancel your order, please contact us using the details set out in clause 1.
13. DISPATCH AND DELIVERY
We will let you know once the goods have been dispatched. If the goods are in stock, they are usually dispatched within 48 hours of our confirmation email. If we are unable to dispatch the goods by this time we will contact you to let you know the reason for the delay.
We use trusted third party couriers such as Royal Mail (tracked or recorded) or similar to deliver our goods.
The estimated date and time window for delivery of the goods is set out in our confirmation email. If something happens which is outside of our control and affects the estimated date of delivery, we will let you have a revised estimated date for delivery of the goods.
Delivery of the goods will take place when we deliver them to the address that you gave to us. If nobody is available to take delivery, please contact us using the contact details at the top of this page.
You are responsible for the goods when delivery has taken place. In other words, the risk in the goods passes to you when you take possession of the goods.
14. RETURNS AND REFUNDS
Should you no longer want the goods, or there is an issue, you may be entitled to a full refund depending on the reason for your return and the nature of the goods you have ordered. Your legal rights are summarised in clause 3 (your legal rights). Nothing in these terms and conditions affects your statutory rights.
Unwanted Items:
You can cancel this contract within 14 days without giving any reason. However, for some goods you do not have the right to cancel or you may lose the right to cancel in certain circumstances (as explained below).
To exercise the right to change your mind, simply post the goods that you do not want back to us within 14 days of you (or the person nominated by you) receiving them and, provided that we receive the goods back in their original condition and accompanied with their original receipt, we will refund you the full amount (including standard delivery costs) in accordance with the “Refunds” section below.
You do not have a right to change your mind in respect of: ·
goods that are made to your specifications or which are personalised/bespoke; or · any goods which become mixed inseparably with other items after their delivery. Your rights to change your mind does not affect your legal rights in relation to faulty or misdescribed goods.
Faulty Goods: We must provide you with goods that comply with your legal rights (as summarised in clause 3 (your legal rights)). If they do not, you may be entitled to a full refund, or, depending on the time, some money back or a repair. Please contact us using the details set out at clause 1 should you believe that your goods are non-compliant with your legal rights.
Returns: All returns must be in their original condition and should be addressed to:

All returns must be accompanied with their original receipt. If you are exercising your right to change your mind, we reserve the right to refuse a refund request and may instead offer you an exchange or issue you with a credit note to the value of the returned goods if the goods are returned without their original receipt or such other proof of purchase that we ask for. This does not affect your legal rights in relation to faulty or misdescribed goods.
If proof of postage has not been provided to us, we reserve the right to refuse all refund requests if we do not receive the goods. If the goods are not suitable for posting, please let us know and we will discuss alternative options with you.
Costs of return: We will pay the costs of return:
if the goods are faulty or misdescribed; or · if you are ending the contract because we have told you of an error in pricing or description or because you have a legal right to do so as a result of something we have done wrong. In all other circumstances (including where you are exercising your right to change your mind) you must pay the costs of return.
Refunds:
If you are entitled to a refund, we will make any refunds (less any deductions that we are entitled to make (see below)) to you as soon as possible and, in any event, no later than 14 days from the day on which we receive the goods back from you or, if earlier, the day on which you provide us with evidence that you have sent the goods back to us.
We may make the following deductions from any refund:·
we may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which is unacceptable. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount. The maximum refund for delivery costs will be the costs of delivery by the least expensive delivery method we offer. For example, if we offer delivery of a product within 48 hours at one cost but you choose to have the product delivered within 24 hours at a higher cost, then we will only refund what you would have paid for the cheaper delivery option.We will make the refund using the same method of payment as you used for the initial transaction and you will not incur any fees as a result of the reimbursement. If full or part payment has been made via a gift card, you will be issued with a new gift card credited with the amount that was paid on the gift card for your original purchase.
All refunds will take into account any offer codes used in connection with your purchase.
15. OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU
We are only liable to you as set out in this contract. We have no other duty or liability to you. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the goods including the right to receive goods which are: as described and match information we provided to you and any sample or model seen or examined by you; of satisfactory quality; fit for any particular purpose made known to us in advance; supplied with reasonable skill and care; and for defective goods under the Consumer Protection Act 1987.
We only supply the goods for domestic and private use. If you use the goods for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
In the absence of negligence on our part, any failure by us to comply with this contract or our Privacy Policy (see clause 4 - How we may use your personal information) or breach by us of our duties under applicable laws we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.
16. OTHER IMPORTANT TERMS
We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.
This contract is between you and us. No other person shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms.
Each of the clauses of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
This contract and any documents referred to in it reflect the whole agreement between us.
If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the goods, we can still require you to make the payment at a later date.
These terms are governed by English law and you must bring legal proceedings in respect of the product in the English courts.
17. ADDITIONAL TERMS APPLYING TO OVERSEAS ORDERS
This clause 17 applies to you if are purchasing goods from outside of the United Kingdom. The terms of this clause 17 shall take priority over any of the preceding terms and conditions in the event of there being any conflict.
Whilst we do accept orders for goods from outside of the United Kingdom, we, reserve the right to refuse orders in certain territories (for example, territories that are the subject to trade sanctions, embargoes or other restrictions). We will let you know once you have placed your order with us if we are unable to accept it for any reason.
Once you have completed the online checkout process and submitted your order to us, we will acknowledge it by email (note that this acknowledgement email does not mean that your order has been accepted) and PayPal will assign a transaction ID to your order and tell you what it is (it will help us if you can tell us the transaction ID whenever you contact us about your order). Once we have acknowledged your order, we will e-mail you to provide you with an accurate freight cost to the country of origin together with details of any additional postage surcharges. If you would like to proceed with your order once we have confirmed the freight costs and additional surcharges to you, you must provide us with a written acceptance of the freight costs and additional surcharges and make payment of such freight costs and additional surcharges by credit or debit card over the phone. A contract will only be formed between us once you make this payment and at this point we will arrange to dispatch the goods to you. If you do not want to proceed once we have confirmed the additional costs to you, please let us know and we will then issue you with a full refund. Your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount and you will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order. The product will be your responsibility from the time you collect it from our nominated overseas distributor/importer. · You must comply with all applicable laws and regulations of the country for which the goods are destined.
